Guns with Drinks and New Bar Liquor License Top 2010 Legislative Recap
In a legislative session where restaurants and bars and even the state ABC appeared to be under attack from numerous political positions, the final results were surprisingly positive.
No Guns Allowed Sign
Guns in Licensed Establishments 
The session saw passage of a revised gun bill that is designed to survive a court challenge. It is now legal for licensed handgun carriers to bring firearms into any place that sells beer or alcoholic beverages, unless the place opts out.  Read more.
Bars Legalized 
On the eve of adjournment, a new liquor license was created that allows establishments selling 15% or more of “prepared food” to obtain a new limited service restaurant license. The law legalizes the vast majority of bars and entertainment venues that did not qualify as a “restaurant” under prior law. ABC to Live for One More Year 
The duration of the ABC as an independent state agency was extended until June 30, 2011. During the legislative session, there was informal discussion of merging the ABC with other agencies, including the Department of Revenue.  Read more.
Premier Tourist Resorts 
As usual, a long list of premier-type tourist resorts and other special legislation were added allowing liquor licenses in places that are otherwise dry.  Read more.
Nutritional Menu Labeling
Restaurant menu labeling was defeated at the state level. Under prior law, local governments were authorized to pass local laws to require restaurants to post calorie, fat and other nutritional information on menus and menu boards.  Read more.
 
In Brief
  • Distilleries now able to charge for tours and tastings conducted in connection with tours.
  • New license created for collectors of commemorative bottles that contain alcoholic beverages.
  • Laws concerning the amounts of alcohol one can legally transport through dry and other counties modified.
  • Technical correction passed allowing liquor stores licensed within the area formerly known as Lakewood to be issued renewal licenses and to stay in business.
 
The Rest of the Story 
Often, some of the most interesting legislative news relates to bills that failed to pass. The 2010 session was no exception. Perhaps the most notable was a bill by Representative Todd and Senator Fowlkes to limit on-premises sales between the hours of 8:00 a.m. and midnight. Read more.
