Franchise Times Features Gigi’s Cupcakes’ Gina Butler

Bonelaw client Gina Butler, who started the Gigi’s Cupcakes brand, is on the cover of the January issue of Franchise Times. The story details Gina’s rise to fame, which includes baked goods instead of country music, and one she made happen with just $33 in her pocket. The California-raised daughter of a farmer moved to Nashville to pursue a career singing country music in the mid-1990s and soon found herself waitressing at Red Lobster and cleaning houses as she worked Music Row. Frustrated that her singing career was not taking off, it was a call from her brother—and a call from a higher power—that led Gina to open her cupcake business. Now, seven years and more than 100 locations later, she is about to see her first international store open (in South Korea) and see herself on an episode of CBS’ Undercover Boss.

Forbes Features Ole Smoky Moonshine

Bonelaw’s Alcoholic Beverage Law client Ole Smoky Distillery was a recent feature in Forbes. Contributor Amy Guttman spoke with Joe Baker, partner in the distillery, about the explosion that company has experienced in the last five years. When state law made it legal to commercially produce “white whiskey,” or “moonshine,” Baker and his partners were the first to apply for a license. As former criminal defense lawyers, they knew the law but not much about distilling or the alcohol business.

Needless to say, they figured it out, and within the first year of operation, the trio saw a 300 percent growth rate. They now employ 200 people and are one of the main attractions in East Tennessee’s Gatlinburg. Recently, they expanded internationally and into chain restaurants like Outback Steakhouse.

Wall Street Journal Covers Ed Yarbrough and Alex Little’s Victory in FDA Drug Misbranding Case

A Tennessee doctor and his wife who ran cancer clinics in East Tennessee and were charged with receiving misbranded drugs have had their jury convictions vacated, thanks to the efforts of Bonelaw attorneys Edward M. Yarbrough and Alex Little. The Justice Department informed the lawyers last night that it would not proceed with the prosecution of the defendants.

Dr. Anindya Kumar Sen and his wife, Patricia Posey Sen, were found guilty at trial of introducing misbranded drugs into interstate commerce, which is a misdemeanor. The Sens had argued that they were deceived by a foreign distributor posing as a U.S. company. Although the jury acquitted Mrs. Sen of all felony charges, it returned misdemeanor convictions against the couple after the district court instructed it that the government need not “prove that a defendant was aware of . . . or . . . intended any wrongful or illegal act.” Dr. Sen and Mrs. Sen appealed the verdicts, and their appeal was pending when the Justice Department sought to dismiss the case.

This appeal is believed to be the first in a prosecution of this type.

New & Bigger Turnip Truck Market Slated for East Nashville

John Dyke, founder of the Turnip Truck markets, talked with the Tennessean about his plans for a new, bigger store in East Nashville, set to open next summer. The natural market at 705 Woodland St. will feature a larger selection of local groceries and produce, juice bar, hot food bar, salad bar, baked goods, meat and seafood departments and beer and wine. With the community support Turnip Truck has received, Dyke said moving to a larger location is necessary and will offer shoppers a better, more enhanced experience. A seating area will overlook the store and neighboring East Park.

Distillers Battle over Tennessee Whiskey Definition

The Tennessean featured an article over the heated debate about a state law defining what “Tennessee Whiskey” is. Several Bonelaw clients are featured in the news, including Diageo, Nelson’s Greenbrier, Full Throttle, Corsair and Pritchard’s. The argument centers around how whiskey should be made—bourbon filtered through sugar-maple charcoal before it is sealed in new, charred, white oak barrels before it is aged.  Some distillers support a state law that strictly defines Tennessee Whiskey, but others want the flexibility to use their own recipes to make Tennessee Whiskey.

Renata Soto, Conexion Americas Receive Presidential Visit & Tennessean Cover Story

Bone McAllester Norton client Conexion Americas and its co-founder and director, Renata Soto, were the feature story on the cover of yesterday’s Tennessean, in advance of President Obama’s visit. In the town hall meeting, the president highlighted his recent immigration actions, saying Nashville, including what Soto is doing, is getting it right.

Soto, originally from Costa Rica, got her first glimpse of helping refugees and immigrants when her mother became part of a solidarity movement that helped people displaced by civil war in Latin American countries. What she thought would be her path to helping others—through journalism—ended up not being her avenue to public service. She has become a leading voice on immigration not just in Music City but across the nation. Tennessean reporter Brad Schmitt interviewed Soto about her upbringing, how she met her husband and her feelings about the president’s visit.

Green Brier Distillery Revived after a Century

Yesterday’s Tennessean included a feature on Andy and Charlie Nelson, heirs of Charles Nelson, whose Green Brier Distillery in Robertson County outsold Jack Daniel’s in the late 1800s. It closed in 1909, but the Nelson brothers, after releasing Belle Meade Bourbon last year, have revived one of their grandfather’s stills, combining history with new technology and forensics. The first house-made brand of whiskey is being pulled off the still now and will drip through sugar maple charcoal before being stored in charred white oak barrels.

The new Nelson’s Green Brier Distillery is open in Marathon Village, 1414 Clinton Street. Tours and tastings are offered hourly throughout the week.

Chef Deb Paquette Announces Plan for New Sylvan Park Restaurant

Bone McAllester Norton client Deb Paquette, chef at SoBro restaurant Etch, has announced plans to open a new dinner-only restaurant in the Sylvan Park area of Nashville next summer. Paquette and partners have leased a 3,000-square-foot space in a building at the intersection of 46th and Utah avenues. While details of what the restaurant will offer are still being worked out, yesterday’s news release explained that diners can expect “an inviting neighborhood atmosphere and relaxed menu at the same level of quality and service Etch diners have come to enjoy.”

Nashville’s Annual Art Crawl CLE will Feature Will Cheek

Goozy Dessert Bar & Café Now Open in Green Hills

Congratulations to Bonelaw client Christie Hauck on the opening of his new dessert bar and café this week in the Green Hills area of Nashville. Goozy specializes in all things indulgent—everything from molten cakes and lemon blancmange to gourmet grilled cheese sandwiches and milkshakes (which you can get with or without alcohol). James Mackler Talks Drones, NTSB Ruling with the Media

Bone McAllester Norton attorney James E. Mackler talked with UAS Magazine last week about the National Transportation Safety Board’s (NTSB) ruling on the Raphael Pirker case. Pirker flew an unmanned aerial system (UAS), more commonly known as a “drone,” over the University of Virginia campus in 2011, and the Federal Aviation Administration (FAA) required him to pay a $10,000 civil penalty for operating the aircraft in a careless or reckless manner. A law judge with the NTSB dismissed that order, citing the FAA had not enacted an enforceable regulation for the aircraft.

“. . .I don’t think it makes very much practical difference in terms of the way the industry and the law are progressing,” James said in the article. “Congress has already told the FAA that they have to come up with regulations governing the commercial use of UAS. Congress has essentially preempted this issue, making it clear that they do expect unmanned systems to be treated as aircraft and operated in a safe manner.”

Earlier that day, James commented in a separate article for the magazine about dispelling a UAS myth. He explained that the Pirker case is more about when the flight occurred and that it had little to do with the current state of UAS regulations.

James served as a panelist in Mind2Marketplace’s event on UAS last week, held at the Smyrna/Rutherford County Airport. “I think it’s going to be another 10-20 years before we see larger UAV’s integrated into airspace. The FAA needs to move a little bit faster in order for it to be allowed to be used in a commercial manner,” he told a reporter from Fox17.

James is the founder of Bonelaw’s UAS focus, the first of its kind in the region. He also leads the firm’s veteran and military law efforts.

Anne Martin & Stephen Zralek Receive Additional Mid-South Super Lawyers Honors
