EPA Issues New Vapor Intrusion Guidance

The United State Environmental Protection Agency (EPA) issued vapor intrusion guidance last week that presents recommendations for how to identify and consider factors when assessing vapor intrusion, making risk management decisions and implementing mitigation pertaining to this potential human exposure pathway. This new guidance may affect real estate developments and acquisitions.

Nashville Film Festival Begins -- Good Time to Consider Legal Issues in Film

Get ready for some great films, Nashville.  Running continuously since 1969, this year's Nashville Film Festival is slated for April 18-25, 2013.  This year's Festival will also celebrate Kurdish Films, presented in part by the Academy of Motion Picture Arts & Sciences.

This is also a great time to consider legal issues in film.  For film-makers, these range from obtaining clearance to use music in films to protecting your script and your work through copyright, both pre-publication and after the movie has been shown to the public; from protecting the name of your film and merchandise through trademark to obtaining permission to model characters after actual people (the "right of publicity"); and from drafting contracts to obtain financing to negotiating distribution deals.  When these issues aren't dealt with on the front end, confusion ensues, feelings get hurt, and lawsuits get filed.

Mike Norton’s Postage Stamp Collages on Display at Appalachian Center for Craft

Bone McAllester Norton president and attorney C. Michael Norton has a talent outside of practicing law: creating colorful collages from postage stamps. More than 10 of his collages are now on display at the Appalachian Center for Craft in Smithville, Tenn. A collector of stamps, Norton is able to utilize every color of the rainbow in the collages, which have a variety of designs and patterns. The exhibit will be on display May 28 – July 16, 2013.

Peg Leg Porker Slated for End of Month Opening in The Gulch

Bone McAllester Norton client Carey Bringle, a local pitmaster, will open a new barbecue restaurant on Gleaves Street, just off The Gulch, in late April. Bringle, known for appearances on Chopped Grill Masters and BBQ Pitmasters, as well as having the second best barbecue sauce in the country by Bon Appetit magazine, says Peg Leg Porker will focus on the barbecue items native to Tennessee. The menu will also feature beer and liquor. A 25-foot barbecue pit will sit on the restaurant’s outdoor patio.

James Crumlin Discusses How to Keep Employees’ Smartphone Use Out of Legal Jeopardy

Because of the rise in court cases involving companies being sued when employees misbehave on mobile devices, attention on the topic is hot. Paul Kruse Article about Google AdWords Published in Intellectual Property Journal

Bone McAllester Norton attorney Paul W. Kruse researched and co-wrote an article that has been published in a leading intellectual property journal. “Is Profiting from the Online Use of Another’s Property Unjust? The Use of Brand Names as Paid Search Keywords” appears in IDEA: The IP Law Review, Vol. 52, p. 131, 2013. The article sets out to answer whether Google’s profiting from the use of others’ brand in its AdWords program is unjust. Paul's co-authors were Daniel Gervais, PhD, FedEx research professor of Law at Vanderbilt University Law School; Martin L. Holmes, attorney with Parker Poe Adams & Bernstein L.L.P.; Glenn Purdue, managing member of Kraft Analytics, L.L.C; and Caprice L. Roberts, professor of law at Savannah Law School.

Bone McAllester Norton to Partner with Habitat for Humanity on Home Build

Bone McAllester Norton will be a partner with Habitat for Humanity of Greater Nashville on a home build in the Park Preserve neighborhood of north Nashville later this month. Construction on the home began in late March and will conclude with the help of the firm’s attorneys and staff members on April 21, 2013. The firm is teaming up with Capital Bank, N.A., a longtime and respected client, on the build for Shatika Johnson-Scott, a widowed mother of six children.

Second Wind Coffee Bar to Open in SoBro This Summer

Bone McAllester Norton client Luke McKee will open a new coffee bar in Nashville's Encore condominium tower in June. Stephen Zralek Quoted in the Tennessean on Importance of Protecting Foreign-Born Citizens from Discrimination in Election Policies

Today, the Davidson County Election Commission voted to rescind a decision to review the citizenship status of newly registered voters born outside the country, noting that doing so would violate the 14th Amendment to the U.S. Constitution. The Black Abbey Brewing Company Selects South Nashville Space as Plans for Production Begin

The Black Abbey Brewing Company, a Nashville-based craft brewer specializing in Belgian-inspired ales, has selected an 11,000 square-foot facility off Sidco Drive in South Nashville as its home, which will include brewing equipment, a tasting room and retail outlet. All is Fair (Use) in Love and Copyright with Stephen Zralek

Bone McAllester Norton’s Stephen Zralek will speak at the March 20th meeting of the Arts & Business Council of Greater Nashville on All is Fair (Use) in Love and Copyright. In his presentation, Stephen will look at several close cases and let attendees judge for themselves as to whether the infringement should be permitted under Fair Use defense. The presentation is interactive, comparing side-by-side examples of original works with later works where the original author claims infringement. Examples include a comparison of Margaret Mitchell’s Gone with the Wind and The Wind Done Gone by Nashville author Alice Randall; a comparison of the original Roy Orbison’s “Pretty Woman” song and 2 Live Crew’s version of it; and a comparison of more recent works created by contemporary photographer Patrick Cariou and appropriation artist Richard Prince. The presentation will explore recent decisions from within the Sixth Circuit and around the country, examining the four factors that courts examine when determining fair use.
