Yarbrough Receives 2017 Nashville Bar Association CLE Excellence Award

The CLE Excellence Award identifies a Nashville Bar member who has demonstrated commitment to the NBA's mission. The Nashville Bar Association is dedicated to the continuation of quality legal education. Ed Yarbrough’s exceptional service to the NBA has paved the way for historical breakthrough for attorneys, community leaders, and civilians.

Yarbrough’s experience on the murder case of Marcia Trimble in 1975 played a key role in producing some of the 2017 CLE seminars. In addition, Mr. Yarbrough’s expertise heavily influenced the development of past programs regarding Baker v. Carr, HOFFA!, and Blanton. These seminars not only provide attorneys with the needed resources to enhance their legal practice and professionalism, but also educate our community on important historical legal events in Tennessee. Ed Yarbrough, BoneLaw Attorney offers Expert Opinion of Rutherford County Domestic Incident

Ed YarbroughEd YarbroughBone McAllester Norton litigator and former US Attorney, Ed Yarbrough, was asked his expert opinion of the recent domestic incident at the home of a Rutherford County Sheriff's Department Deputy.  The incident was handled with cell phones and without using standard protocol procedures.

Mr. Yarbrough suggested that Chief Deputy Garrett should not have contacted his own officers to investigate.  "The problem is, any time a senior officer puts one of his subordinates in the position of doing what the boss says, or doing what the law requires, that's a conflict of interest,"  Yarbrough said.

“We are pleased by today’s decision. It provides a commonsense solution to most of the problems posed by The Tennessean’s ill-conceived effort to publish evidence in a pending criminal case. We argued that courts should protect the confidentiality of crime victims, and this decision helps accomplish that goal. But the nature and scope of victims’ rights in Tennessee remain unclear, and our client was disappointed that the Court avoided these critical questions. Crime victims in Tennessee should be able to pursue justice without subjecting themselves to abuse, intimidation, and harassment. To the extent this decision helps victims do so, it is an important step forward.”

Ed Yarbrough & Alex Little Urge Tennessee Supreme Court to Protect Victims’ Rights

A Tennessee Supreme Court case could determine the scope of the state’s public records law, and Bonelaw attorneys Edward M. Yarbrough and Alex Little argued against disclosure of such records. They represent the victim in the highly publicized Vanderbilt rape case. Last year, a conglomeration of media outlets in the state argued for access to records reviewed in the police investigation in that case. The government said laws regarding procedure in criminal courts and victims’ privacy laws keep those records shielded from public release. Yarbrough and Little are advocating for protection of victims in criminal cases.

Healthcare Fraud and Introducing Misbranded Cancer Drugs into Interstate Commerce with Ed Yarbrough and Alex Little

Bone McAllester Norton attorneys Edward M. Yarbrough and Alex Little are slated as presenters at the Tennessee Alliance for Legal Services’ (TALS) Winter Meeting. Their presentation, “Healthcare Fraud and Introducing Misbranded Cancer Drugs into Interstate Commerce” will review the case history of a federal criminal prosecution in East Tennessee. The defendants, an oncologist and his wife who served as the practice manager for his clinic, were indicted for multiple counts of healthcare fraud and introducing misbranded cancer drugs into interstate commerce.

In the presentation, Ed and Alex will discuss the initial investigation by the Food and Drug Administration agent and the Federal Bureau of Investigation agent, as well as the motion to suppress all evidence seized by the agents, other pretrial motions and the trial itself. They will address how they were able to have the convictions vacated and the cases remanded to trial court for dismissal with prejudice.

Ed and Alex are members of the firm’s Criminal Defense and Government Investigations practice. Ed has been a successful trial lawyer in Nashville for more than 40 years and is a former U.S. Attorney. Alex is a former federal prosecutor and served as Assistant U.S. Attorney for the Middle District of Tennessee.

Wall Street Journal Covers Ed Yarbrough and Alex Little’s Victory in FDA Drug Misbranding Case

A Tennessee doctor and his wife who ran cancer clinics in East Tennessee and were charged with receiving misbranded drugs have had their jury convictions vacated, thanks to the efforts of Bonelaw attorneys Edward M. Yarbrough and Alex Little. The Justice Department informed the lawyers last night that it would not proceed with the prosecution of the defendants.

Dr. Anindya Kumar Sen and his wife, Patricia Posey Sen, were found guilty at trial of introducing misbranded drugs into interstate commerce, which is a misdemeanor. The Sens had argued that they were deceived by a foreign distributor posing as a U.S. company. Although the jury acquitted Mrs. Sen of all felony charges, it returned misdemeanor convictions against the couple after the district court instructed it that the government need not “prove that a defendant was aware of . . . or . . . intended any wrongful or illegal act.” Dr. Sen and Mrs. Sen appealed the verdicts, and their appeal was pending when the Justice Department sought to dismiss the case.

This appeal is believed to be the first in a prosecution of this type.

“Take Victim’s Rights Seriously,” Ed Yarbrough Tells the Tennessean

Bone McAllester Norton attorney Edward M. Yarbrough spoke with the Tennessean yesterday about how the state’s laws on open records, fair trials and victims’ privacy rights converge as cases move through the courts. The subject was the Vanderbilt rape case, which was heard in appeals court Monday. A media coalition filed lawsuit after being denied case information, including text messages sent between players and coaches following the incident that took place last June in a Vanderbilt dorm. Presiding Judge Frank G. Clement, Jr. questioned why media should have access to such records prior to the trial.

“. . .if we need to go a little further than we would like to restrict the Public Records Act, then we should do it,” Ed told reporter Tony Gonzalez. “The time has come to take victim’s rights seriously and put them right up there with civil rights and all constitutional rights.”

Ed Yarbrough Talks to FOX 17 about Possible Precedent-Setting Vanderbilt Rape Case

Bone McAllester Norton attorney Edward M. Yarbrough talked with Erika Lathon from Nashville’s WZTV-TV yesterday about the lawsuit dozens of media outlets have filed to gain access to records in the Vanderbilt rape investigation, using the Freedom of Information Act. He and the state have filed a motion to keep that information from going public. In the exclusive interview, Ed is concerned the victim would not be afforded her right to dignity and compassion in the criminal justice system if these documents are released.

Twelve Bone McAllester Norton Attorneys are Named 2013 “Mid-South Super Lawyers”

Nashville, TN – The 2013 Mid-South Super Lawyers list was released today, and 12 Bone McAllester Norton PLLC attorneys were included. Eight have been named as Mid-South Super Lawyers, while four have been included as Mid-South Rising Stars.


Mid-South Super Lawyers are selected through a multi-phased process, which includes independent research, peer nominations and peer evaluations. The list is produced by Super Lawyers, a national rating service that includes more than 70 practice areas.

Super Lawyers also selects attorneys to be included in the Rising Stars list, which is compiled using the same requirements and selection process as the Super Lawyers list. However, to be eligible for inclusion in Rising Stars, a candidate must be either 40 years old or younger, or in practice for 10 years or less.

The eight attorneys named to the 2013 Mid-South Super Lawyers list include:


    • James A. Crumlin, Jr., who made the list for Employment & Labor. He concentrates his practice in the areas of labor and employment law, small and mid-sized business representation and corporate business litigation.

    • Sharon O. Jacobs, an attorney with environmental litigation experience at the federal, state and local levels, made the list for Environmental law.

    • Anne C. Martin was selected for Employment Litigation Defense. She is a commercial litigation and employment lawyer, representing both employers and employees.

    • Sam J. McAllester, III represents financial institutions and concentrates his practice in the areas of commercial lending, creditors’ rights and financial consultations. He was named to the list for Real Estate law.
