Stephen Zralek will Co-Present and Speak at a Nashville Bar Association CLE on Nov. 6

Bone McAllester Norton Stephen J. Zralek will co-present and serve as a panelist for a Continuing Legal Education program sponsored by the Nashville Bar Association on Wednesday, Nov. 6. “Advanced Federal Court Practice Insider Tips for Lawyers Practicing in the U.S. District Court for the Middle District of Tennessee” will address how to conduct an effective meet and confer, handle an extraordinary relief claim and communicate with the press about your claim. Stephen’s panel, “Extraordinary Relief,” takes place from 2:40 to 3:40 p.m. and will include tips related to ex parte communications, temporary restraining order hearings and preliminary injunction hearings, filing documents under seal, impoundment and the use of U.S. Marshals.

Stephen Zralek will Present “Averting a Social Media Nightmare” to Ryan Connections on October 17

Bone McAllester Norton Stephen J. Zralek will discuss steps and precautions to take to keep yourself—and your business—out of legal trouble in the social media sphere when he speaks to Father Ryan High School’s Alumni Association at Ryan Connections on Thursday, Oct. 17. “Averting a Social Media Nightmare” will highlight recent examples of social media disasters in hope that others can learn from their lesson. Stephen will give some good rules for the road and will help audience members spot issues ranging from online defamation and malicious reviews, copyright infringement and creating shields against liability to endorsements, employment issues and protecting children’s privacy online.

Stephen was among the first attorneys to embrace social media within his own practice and to identify social media as comprising its own niche in the law. As a thought leader in Social Media Law and in Intellectual Property, Stephen is routinely called on by businesses and other attorneys for guidance in these constantly-shifting arenas.

Stephen Zralek Slated to Discuss Preventing Brand Thievery at KEEN Digital Summit

Bone McAllester Norton Stephen J. Zralek will speak on a panel discussion, titled “Watch Your Back: Preventing Brand Thievery,” at the upcoming KEEN Digital Summit. The panelists will use the situation involving Turner Barr’s “Around the World in 80 Jobs” being swiped without his permission to discuss what rights business people have, steps they need to take to avoid an expensive disaster later down the road and how to protect their brand through the legal process.

Serving on the panel with Stephen is Barr and Stephen Oddo, co-founder of Walks of Italy. Ryan Underwood, business editor for Vanderbilt University’s Owen Graduate School of Management, will moderate.

The discussion will take place Friday, Oct. 25 at the Omni Nashville.

Anne Martin Takes Home High Award in Nashville Business Journal’s Best of the Bar Awards

Stephen Zralek Quoted in the Tennessean on Importance of Protecting Foreign-Born Citizens from Discrimination in Election Policies

Today, the Davidson County Election Commission voted to rescind a decision to review the citizenship status of newly registered voters born outside the country, noting that doing so would violate the 14th Amendment to the U.S. Constitution. Bone McAllester Norton attorney Stephen J. Zralek serves as a member of the steering committee of Nashville for All of Us and said, “We agree that only U.S. citizens should vote, but this proposal was an insult to U.S. citizens who weren’t born here.”

All is Fair (Use) in Love and Copyright with Stephen Zralek

Bone McAllester Norton’s Stephen Zralek will speak at the March 20th meeting of the Arts & Business Council of Greater Nashville on All is Fair (Use) in Love and Copyright. In his presentation, Stephen will look at several close cases and let attendees judge for themselves as to whether the infringement should be permitted under Fair Use defense. The presentation is interactive, comparing side-by-side examples of original works with later works where the original author claims infringement. Examples include a comparison of Margaret Mitchell’s Gone with the Wind and The Wind Done Gone by Nashville author Alice Randall; a comparison of the original Roy Orbison’s “Pretty Woman” song and 2 Live Crew’s version of it; and a comparison of more recent works created by contemporary photographer Patrick Cariou and appropriation artist Richard Prince. The presentation will explore recent decisions from within the Sixth Circuit and around the country, examining the four factors that courts examine when determining fair use.

Bone McAllester Norton attorney Stephen Zralek was quoted in a January 29 article in Nashville’s The City Paper regarding copyright infringement lawsuits.

“It was only a matter of time before copyright trolls filed a bit-torrent lawsuit in Tennessee,” he said. “By law, the [Internet Service Providers] are required to reach out to the John Does and tell them they have 30 days to file a ‘motion to quash’ the subpoena or otherwise settle the lawsuit. If the individuals take no action, the ISPs will release their identities to the Plaintiff, after which the Plaintiff will amend the complaint to name the individual in the copyright infringement action — for all the world to see.”

Attendees will look at several close cases and will judge for themselves under the guidance of Stephen, who is highly sought after in rights of publicity, copyrights, trademarks and privacy.
